You must repay any overpayments to the N.C. Division of Employment Security (DES).  An overpayment means that you were paid unemployment benefits you were not entitled to get. You must pay the total to avoid debt collection. If you cannot pay the total balance, you may set up a payment plan online or by contacting a Recovery Specialist at 888-737-0259. You will get monthly statements showing your balance and the minimum amount that you must pay monthly.

You can make payments by:

  • Credit Card
  • Debit Card
  • Check
  • Money Order

Credit and debit card payments may be made through your MyNCUIBenefits account.

Collections

It is best to set up a payment plan, so that overpayments won’t be collected in other ways. DES may collect money by: 

  • Withholding your earnings.
  • Withholding your federal tax refund.
  • Withholding your state tax refund.
  • Withholding your lottery winnings.
  • Beginning criminal prosecution and/or civil court action. 

If you have an overpayment balance while you are getting benefits, your benefits will be cut by: 

  • 50% for non-fraud overpayments or
  • 100% for fraud overpayments.  

NOTE: You may request a waiver for non-fraud overpayments after your appeal rights have expired and the appeal decision is final.  

  • Collection of fraud overpayments cannot be waived.  
  • Submit a waiver request online or fax it to 919-857-1296.  

Repayment of non-fraud overpayments may be waived for good cause. Waiver requests should be filed after the appeal rights expire on the determination of overpayment.
